The terms “our”, “we”, “us” in this document refer to the entity WATERMAN BUSINESS CENTRES PTY LTD.

What is the Fair Play Policy?

It is important to us that our all customers have fair access our products and services. Because of this, you must follow our Fair Play Policy when you use any of our products and services where you do not hold an exclusive license agreement for use.

Examples of non-exclusive product and services
  • Internet access
  • Common spaces
  • Business lounges
  • Meeting rooms
  • Hot Desks 
  • Kitchen and kitchen facilities
  • Phone and phone lines
Examples of exclusive product and services
  • Your private office
  • Your dedicated desk
  • A meeting room booked by you
1.2 Purpose

Our Fair Play policy is intended to ensure that our customers do not use our products and services in an excessive, unreasonable, exploitive or fraudulent manner or in connection with equipment that has not been approved by Waterman Business Centres. 

Such usage may impact the reliable operation of our products and services, our ability to provide said products and services and/or the customer experience of the other members using said products and services. Legitimate use of our services for their intended purposes for which they are supplied to you will not breach our Fair Play Policy. 

1.3 When do we exercise our rights to enforce the Fair Play Policy?

We will enforce our Fair Play Policy where we reasonably consider that you have used our products and services in a way that is excessive, exploitive, fraudulent or unreasonable.

Examples of excessive, exploitive or unreasonable use
  • Holding formal meetings in common spaces and kitchens
  • Leaving personal belongings or other items at a hot desk, workstation or seat in common spaces and business lounges for the purpose of preventing or deterring others from using that hot desk, workstation or seat while it is otherwise not in use
  • Occupying more than one hot desk, workstation or seat per person
  • Bringing personal equipment such as computer monitors, printers, or other bulky items into a Waterman Centre without express permission from Waterman
  • Downloading/uploading excessive quantities of data throughout business hours 
  • Arranging pallets of stock to be delivered to your mailbox
  • Holding parties in common spaces and kitchens
  • Setting up a large call centre in the hot desk area without license
  • Reselling or commercially exploiting any Waterman products or services without express permission from Waterman
  • Aggressive, abusive, or offensive language and/or behaviour
  • Excessive noise, including unreasonably loud music or media, shouting, or any other noise which has the potential to disrupt the fair and reasonable enjoyment of the space by other members
  • Public indecency of any kind, or displaying explicit, offensive, or illegal material
  • Any other scenario, behaviour, or usage which causes significant disruption to the fair and reasonable use of any of our products and services by other Waterman members
General

2.1 General Product and Services

(a) Unless you hold a license for exclusive use of a product or service you must not use any of our products or services in a way that is excessive, exploitive, fraudulent or unreasonable.

2.2 Technical Products and Services

(a) You must not use any of our data and voice services in a way that is excessive, exploitive, fraudulent or unreasonable.

(b) We consider it excessive, exploitive, fraudulent or unreasonable where you use a data and voice service in a manner that

 (i) impacts the network performance and/or customer experience, and/or

(ii) jeopardises the digital security of our customers.

Our Rights

3.1 What we can do if you breach our Fair Play Policy

If we reasonably believe that you are in breach of this Fair Play Policy we can: 

(a) Require that you can change or upgrade your product to another product 

(b) Cancel or limit your right to use a product or service offer without telling you before we do so; 

(c) Suspend or cancel your products and services which have been misused by telling you in writing 30 days before we do so. 

3.2 Termination Charges & Penalty Fees 

(a) If we believe on reasonable grounds that you are in breach of this Fair Play Policy, you must pay the cancelation charges applicable for any product or services we have cancelled or suspended as a result of the breach.

(b) If we believe on reasonable grounds that you are in breach of this Fair Play Policy, you will be required to pay any costs which arise from damages or loss incurred due to the excessive, exploitive, fraudulent or unreasonable activity.
